Divorce FAQs

How much does it cost to get divorced?

The average cost of a divorce is often cited as £15,000, although this can be misleading as costs will vary from case to case depending on whether child arrangements and/or finances are disputed and the extent to which professional assistance is therefore required. Costs can be broken down into legal fees, court fees, and potential reductions. Additional legal assistance or mediation should also be taken into consideration, and it’s important to note that mediation could be free of charge if you’re eligible for legal aid. Other associated costs can include valuation, financial advisor, and relocation. Learn more about the costs of getting divorced in our guide.

How do I start divorce proceedings?

To initiate the divorce process, one of the spouses must file for a matrimonial order. This involves filling out an online form with details about both partners and submitting a standard fee of £593.

Do I have to cite a reason for the divorce?

Since the introduction of no-fault divorce in April 2022 in England and Wales, you no longer need to cite a specific reason for the breakdown of your marriage. The new law allows one or both spouses to apply for divorce by stating that the marriage has irretrievably broken down, eliminating the need to attribute blame or wait for a defined period. This simplifies the process and reduces conflict, providing a more amicable option for couples seeking to end their marriage.

How long does it take to get a divorce?

Typically, a divorce takes approximately 4 to 6 months, assuming mutual agreement and straightforward affairs between spouses. The process involves obtaining a decree nisi, usually granted a few weeks after the initial application. The final confirmation, known as the decree absolute, can be applied for 43 days after receiving the decree nisi. Learn more about the divorce process.
